How can I recover damages?

There are many options to explore to ensure you receive the maximum compensation that you’re entitled to. These may include:

  • Liability insurance coverage of the driver at fault for the accident. Under state law, the minimum required liability policy limits are $25,000 for bodily injury or death of one person; $50,000 for bodily injury or death of two or more people; and $20,000 for property damage.

  • Uninsured or underinsured motorist (UM/UIM) coverage. The Insurance Information Institute estimates that 12% of Virginia drivers are uninsured. If you have been injured in an accident caused by a driver with no liability insurance or a hit-and-run driver – you may be entitled to compensation under your own uninsured motorist coverage.

Strategy Points

  • In short, no. Virginia is what’s called a contributory negligence state. That means that if you were even partially responsible for the accident, you will not be able to recover amages.

  • We can still recover damages through your own car insurance policy. This is called uninsured motorist coverage. If the person who hit you had no coverage, we can still recover your damages up to your own policy limits.

  • You can recover both economic and non-economic damages. Economic damages are things like medical bills (the full billed amount), lost wages, and the expected costs of future medical care. Non-economic damages are the pain, suffering, inconvenience, and loss of enjoyment of life and inability to perform daily activities. These non-economic damages are much harder to value, but we will work together to ty and place a value on these items.

  • You should always speak to and hire a lawyer before speaking with the other driver’s insurance adjuster. Their goal is to settle your claim for as little as possible. Talking to a lawyer first can help you organize your thoughts, ideas, and memory of the collision and provide you a better chance to understand the full scope of your injuries.

  • You can file a claim with the insurance company at any time after the collision, but you have 2 years from the date of the collision to resolve your claim. If you cannot resolve your case within the 2 year limitation (known as the statute of limitations), you and your lawyer will need to file a lawsuit to preserve your ability to pursue the claim.

  • First, insurance companies will almost always offer a lower settlement offer if you pursue your claim without a lawyer. If you have received a rejection letter, you should discuss it with a lawyer.
